VERTEX MASTERY – TERMS & CONDITIONS

INTRODUCTION

1. These Terms & Conditions govern your purchase of and participation in any programs, services, or offerings conducted by Vertex Mastery Sdn Bhd (“the Company”).
   
   By purchasing, registering for, or participating in any of the Company’s programs, services, or offerings, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.

VALIDITY

2. All programs, services, and bundled offerings must be utilised within eighteen (18) months from the date of purchase unless otherwise stated.
   
   It is your responsibility to schedule and attend within this period. Any unused entitlement after the validity period shall lapse without refund or replacement.

BUNDLED OFFERINGS

3. Where programs or services are purchased as part of a bundle, they are considered a single combined offering and are not separable.
   
   Individual components within a bundle cannot be exchanged, substituted, or refunded independently.

PARTICIPATION AND UTILISATION

4. Participation in any portion of a program or service constitutes commencement of usage.
   
   As a general policy, once participation has begun, registrations are considered utilised and are not eligible for refunds, transfers, or changes.
   
   Any exceptions are subject to Clause 7 and are granted at the sole discretion of the Company.

PARTICIPANT RESPONSIBILITY

5. Our programs and services are designed for committed participants. You are responsible for managing your schedule and attending as required.
   
   Missed sessions, scheduling conflicts, change of mind, or personal circumstances do not qualify for refunds, credits, transfers, or extensions.

TRANSFER OF REGISTRATION

6. You may transfer your registration to another individual subject to the following conditions:

   
   (a) Transfer is permitted one (1) time only and must be approved by the Company prior to the start of the program or service;
   (b) No transfers are allowed within seven (7) days before the scheduled start date;
   (c) No transfers are allowed after any participation has taken place.

   
   All approved transfers are final.

RESCHEDULING AND REATTENDANCE

7. Requests to reschedule or reattend due to illness, emergencies, or other personal circumstances are not guaranteed and will be considered on a case-by-case basis at the sole discretion of the Company.
   
   Where such requests are approved, they may be subject to an administrative fee and availability of future sessions.
   
   Any applicable administrative fee will be communicated at the point of approval.

   
   Approval of any request does not constitute a waiver of these Terms & Conditions.

CHANGES TO PROGRAMS OR SERVICES

8. The Company reserves the right to modify schedules, formats, venues, delivery methods, or structure of any program or service where necessary. Such changes do not entitle you to any refund.

DISCONTINUATION

9. In the event that any program or service is no longer available, the Company will provide one of the following:

   
   (a) a replacement program or service of equal or higher value; or
   (b) a credit for future use.
   
   No cash refunds will be provided.

TRAINERS AND FACILITATORS

10. The Company reserves the right to assign, change, or substitute trainers, facilitators, or service providers at any time.
    
    Preference for a specific individual shall not be a basis for cancellation, refund, or transfer.

UNFORESEEN CIRCUMSTANCES

11. There may be situations beyond the Company’s control (including illness, emergencies, or external events) that require adjustments.
    
    The Company reserves the right to reschedule or make reasonable modifications without liability.

PAYMENT AND REFUND POLICY

12. All payments made are non-refundable unless otherwise stated in a separate written policy for a specific program or service.
    
    Failure to participate does not entitle you to any refund, credit, or transfer.

EXCEPTIONS

13. Any exception to these Terms & Conditions is made strictly at the sole discretion of the Company and does not constitute a waiver of any rights.

DATA PROTECTION

14. By engaging with the Company’s programs or services, you consent to the collection, use, and processing of your personal data for purposes including administration, communication, and marketing in accordance with applicable Malaysian laws.

LIMITATION OF LIABILITY

15. To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential loss arising from your participation in any program or service.
    
    The Company’s total liability shall not exceed the amount paid by you.

NO GUARANTEES AND OUTCOMES

16. All programs and services are provided for educational and development purposes. The Company does not guarantee any specific results, outcomes, or success from participation.
    
    Results will vary based on individual effort, application, and circumstances beyond the Company’s control.
    
    You acknowledge that your results are solely dependent on your own actions and decisions.

INTELLECTUAL PROPERTY

17. All materials, content, frameworks, and methodologies remain the intellectual property of the Company.
    
    You may not reproduce, distribute, record, or share any content without prior written consent.

GENERAL

18. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
    
    These Terms & Conditions constitute the entire agreement between you and the Company.
    
    The Company reserves the right to amend these Terms & Conditions with prior notice.

GOVERNING LAW

19. These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.
